Mourjan Terms of Use

1. Introduction

Welcome to Mourjan. By accessing or using the website, you agree to be bound by these Terms of Use ("Terms"), which ensure that Mourjan works effectively for everyone. Mourjan is provided to you by Mourjan Classifieds FZ-LLC, located at Business Center RAKEZ, Ras Al Khaimah, United Arab Emirates, and registered under license number 45000209.

If you do not agree to these Terms, you may not access or use our services.

2. Eligibility and Account Security

• Age Requirement: By using Mourjan, you represent that you are at least 18 years of age.

• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account.

• Sanctions Compliance: Mourjan will NOT deal with or provide any services or products to any countries sanctioned by the OFAC (Office of Foreign Assets Control) in accordance with the laws of the United Arab Emirates.

3. Usage Rules and Prohibited Conduct

As a condition of your use of Mourjan, you agree strictly NOT to:

  • Violate any local, federal, or international laws.
  • Violate the Posting Rules or post any threatening, abusive, defamatory, obscene, or indecent material.
  • Post false or misleading content.
  • Infringe upon any third-party rights (including intellectual property).
  • Distribute spam, chain letters, or pyramid schemes.
  • Distribute viruses or any other technologies that may harm Mourjan or the interests/property of its users.
  • Impose an unreasonable load on our infrastructure or interfere with the proper working of the site.
  • Copy, modify, or distribute any other person's content without their consent.
  • Use any robot, spider, scraper, or other automated means to access Mourjan and collect content for any purpose without our express written permission.
  • Harvest or otherwise collect information about others (including email addresses) without their consent.
  • Bypass measures used to prevent or restrict access to Mourjan.

4. Content and Intellectual Property

  • Ownership: Mourjan contains content from us, you, and other users. Mourjan is protected by copyright laws and international treaties. Content displayed on or via Mourjan is protected as a collective work and/or compilation.
  • User License: When you provide content to Mourjan, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.
  • Restrictions: You agree not to copy, distribute, or modify content from Mourjan without our express written consent. You may not disassemble, decompile, reverse engineer, or attempt to discover any source code contained in Mourjan. You agree not to reproduce, copy, sell, resell, or exploit any aspect of Mourjan (other than your own content).
  • Infringement: Do not post content that infringes the rights of third parties (e.g., counterfeit items). Entitled parties, specifically owners of copyright or trademark rights, can report offers that infringe on their rights. If a legal representative of the entitled party reports this to us correctly, infringing products will be removed.

5. Fees, Payments, and Refunds

Using Mourjan is generally free, but we may charge fees for certain optional services.

  • Transparency: If a service incurs a fee, you will be able to review and accept the terms and costs disclosed at the time of posting.
  • Currency: Fees are quoted in your local currency and/or US Dollars (USD). We accept online payments via Visa and MasterCard credit and debit cards, in the following currencies: AED for customers within the United Arab Emirates, and USD for customers in all other countries.
  • Transaction Details: The displayed price and currency at the checkout page will be the same price and currency printed on the Transaction Receipt. The amount charged to the card will be shown in your card currency.
  • Payment Security: If you make a payment, the details you submit will be provided directly to our payment provider via a secured connection. The cardholder must retain a copy of transaction records and Merchant policies/rules. Multiple transactions may result in multiple postings to the cardholder’s monthly statement.
  • Payment Confirmation: Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt.
  • Non-Refundable: Our fees are non-refundable neither cancelable, and you are responsible for paying them in advance.
    Refunds, if applicable under specific circumstances, will be done only through the Original Mode of Payment and will be processed within 10 to 45 days depends on the issuing bank of the debit/credit card.
  • Collection: If your payment method fails or your account is past due, we may limit your ability to use the services and collect fees owed using other collection mechanisms.

6. Global Marketplace

Some features may display your ad on other sites, such as search engines or our classifieds sites in other countries. By using Mourjan, you agree that your ads can be displayed on these external platforms. When posting on another site, you are responsible for ensuring compliance with that site's policies and local laws.

7. Disclaimers and Limitation of Liability

  • No Warranty: We do not review users' postings and are not involved in actual transactions between users. We do not guarantee the accuracy of postings, user communications, or the quality, safety, or legality of items offered. To the extent legally permitted, we expressly disclaim all warranties, representations, and conditions, express or implied, including those of quality, merchantability, durability, and fitness for a particular purpose.
  • Service Availability: We cannot guarantee continuous, error-free, or secure access to our services.
  • Limitation of Liability: We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Mourjan.
  • Liability Cap: If we are found to be liable, our liability to you or any third party is limited to the greater of: (a) the total fees you paid to us in the 12 months prior to the action giving rise to liability, or (b) 100 US Dollars.
  • Indemnity: You agree not to hold us responsible for things other users post or do. Nothing in these terms limits our liability for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

8. Data Privacy and Account Termination

  • Data Processing: By using Mourjan, you agree to the collection, transfer, storage, and use of your personal information by Mourjan on servers located in Germany, Lebanon, and the United Arab Emirates, as further described in our Privacy Policy.
  • Data Retention: You agree that your account and any collected data cannot and will not be deleted for the sole reason of avoiding a claim or dispute. We reserve the right to retain materials required to respond to claims or resolve disputes that may arise in the future.
  • Termination: We reserve the right to restrict, suspend, or terminate a user's access to the site if we believe they are creating problems, breaching policies, or acting inconsistently with the spirit of our terms.

9. Governing Law and Dispute Resolution

  • Jurisdiction: This Agreement shall be governed and construed in all respects by the laws of the United Arab Emirates. You agree that any claim or dispute you may have against Mourjan Classifieds FZ-LLC must be resolved by the courts of the United Arab Emirates.
  • Resolution Process: If a dispute arises, we encourage you to first contact us directly via the Mourjan contact page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration.

10. General Provisions

  • Entire Agreement: These terms and other policies posted on Mourjan constitute the entire agreement between you and Mourjan, superseding any prior agreements.
  • Updates: Mourjan Policies and Terms & Conditions may be changed or updated occasionally to meet requirements and standards. Modifications will be effective on the day they are posted. Users are encouraged to visit these sections frequently to stay updated.
  • Severability: If a court strikes down any of these terms, the remaining terms will survive.
  • Assignment: We may automatically assign this agreement in our sole discretion.
